Puppy Purchase Contract

The breeder states:

Our goal at Cotton Kennels is to promote sound and stable temperaments, but most important, healthy, happy dogs that can perform whenever duty calls, whatever that duty may be. The American Bulldog is a very capable dog. They can and often do excel in many activities such as farm work, showing, personal protection, dog sports such as IPO or schutzhund, weight pulling or simply a loving family pet.

Perhaps that is why they are well known as the farm/utility dogs of the South.  The sire and dam of this American Bulldog are purebred, registered dogs that exhibit even temperament and sound structure to the naked eye. The sire and dam were bred with the best of intentions to produce healthy and stable pups. The American Bulldog pup you are purchasing is not guaranteed to be show quality, to become a champion or a breeding prospect, even though it is entirely possible that the pup/dog may uphold these expectations.

You are strongly encouraged to have your new pup examined by YOUR vet within 5 days!  If you are unsatisfied with your pup, please return it to us immediately! Though we may choose to refund your entire purchase price (if within 5 days), we cannot be responsible thereafter, once the pup/dog has left our care and been exposed to an unknown environment.  Please note:  NO REFUNDS or money will be issued after 5 days have passed.
 
We offer two purchase plans for our pups. The choice is up to you.  (see below for further explanation).

DISCOUNTED PET PRICE PLAN:

The discounted price (does not include any shipping cost), while considerably lower than the guaranteed price, comes with a limited six month health guarantee against severe congenital diseases that would be considered terminal or life threatening, such as those involving the heart, liver, lungs, kidneys, brain etc. Such a finding must be verified in writing by a state licensed veterinarian in your state of residence and confirmed by the breeder's veterinarian, if requested. The buyer will be responsible for any and all charges concerning verification.

If such a defect as mentioned is found prior to the pup turning six months of age, the buyer will be eligible for a replacement puppy. When a replacement pup is requested, the breeder will replace the above described pup with another American Bulldog pup in good health, of the purchaser's choice, although not necessarily from the same litter. If no pups are available at that time, the purchaser will be entitled to reserve a pup from a future litter, if he or she so chooses. The breeder shall be under no specific time constraint, but should replace the pup from their next upcoming litter, if one is not available at the time. No other guarantees or warranty shall apply and no monetary compensation will be offered or given.

You are already getting the pup at a heavily discounted price for the breed and are purchasing the pup with a limited six month health guarantee. You are fully responsible for the pup once it leaves our premises. You must still sign the "Puppy Agreement" in acknowledgment that you are choosing the Discounted Price Plan with the understanding that the breeder is not responsible, once the pup has left their care. The only exceptions being the conditions covered under the limited six month health guarantee. You are also still bound by the terms of this agreement, except those pertaining to the Guaranteed Price Plan.

2 YEAR PLUS GUARANTEED PRICE PLAN:

The guaranteed price comes with the following health guarantee (does not include any shipping cost):

1) A period of 27 months from the American Bulldog's date of birth against severe crippling canine hip dysplasia (CHD). Vitamin C supplements or other approved supplement plan must have been maintained during this period, and the pup fed a quality food, preferably designed for large breeds. The puppy should be kept lean and not have been overfed or allowed to become overweight. It must not have been allowed to engage in overly-strenuous physical activity or excessive jumping.  The pup/dog should not participate in weight pull training or events, until they are over 24 months and have had their hips checked to ensure soundness.  Also it must not have been over-supplemented with calcium or phosphorus. According to research, these things can contribute to joint problems and even the development of hip dysplasia.

Proof of purchase of the supplements in the correct dosage, as well as receipts for the food (instructions as provided in your puppy packet) will be required, otherwise this guarantee will be considered null and void.  Any claim of hip dysplasia must be made in writing with a copy of x-rays being provided as proof. The dysplasia must be verified by either OFA results, Penn Hip results or by a licensed veterinarian. For results provided by means other than OFA or Penn Hip, the breeder reserves the right to ask for this to be confirmed by their own veterinarian. The buyer will be responsible for any and all charges concerning verification.    

2) A period of 24 months from the American Bulldog's date of birth against the "generalized coverage" type of demodectic mange (also known as red mange). This must be verified in writing by a state licensed veterinarian.  The breeder reserves the right for this to be confirmed by their own veterinarian. The buyer will be responsible for any and all charges concerning verification.

3) A period of 24 months for severe, crippling or disabling congenital diseases such as those affecting the heart, liver, kidneys, brain or other internal organs. This must be verified in writing by a state licensed veterinarian.  The breeder reserves the right for this to be confirmed by their own veterinarian. The buyer will be responsible for any and all charges concerning verification.

4) A period of 72hrs after receipt of American Bulldog by purchaser against death caused by parvo or distemper, if these diseases were derived from the breeder's premises. This must be verified in writing by a licensed veterinarian in your state of residence and confirmed by the breeder's veterinarian as authentic. The buyer will be responsible for any and all charges concerning verification.

Guarantee (1) pertains to severe crippling canine hip dysplasia (CHD).  If hip dysplasia is confirmed via OFA, Penn Hip or veterinarian diagnosis, the buyer will be eligible for a partial cash back refund, for half the purchase price or a replacement pup, but not both. This amount DOES NOT include shipping or any other miscellaneous charges. The guarantee covering the above terms (2-4) is a "replacement only" guarantee and not a cash back refund.

For all items (1-4) when a replacement pup is requested, the breeder will replace the above described pup with another American Bulldog pup. The pup should be in good health, of the purchaser's choice, although not necessarily from the same litter. If no pups are available at that time, the purchaser will be entitled to reserve a pup from a future litter, if he or she so chooses. The breeder shall be under no specific time constraint, but should replace the pup from their next upcoming litter, if one is not available at the time.

If the purchaser elects to keep the pup, it should be spayed/neutered at the purchaser’s expense and verified in writing by a licensed veterinarian. The buyer will be responsible for any and all charges concerning sterilization and verification. If the buyer wishes to return the pup/dog to the breeder, the proper registration paperwork must be included, signing ownership back to breeder. The cost and related expenses of returning the dog to the breeder shall be the sole responsibility of the purchaser. The purchaser is also responsible for any and all expenses, both past and present including, but not limited to medical treatment charges, veterinary fee’s, boarding fees etc. while the animal was/is in their care, up until the pup is returned to the care of the breeder.

This guarantee will be considered null and void for any of the following conditions: the American Bulldog has been used for any illegal activities or purposes; the American Bulldog was bred before 2yrs of age, involved in a traumatic, or crippling accident; was abused, malnourished, neglected, abandoned, sold, traded, given away, confiscated, picked up by an animal control officer, denied necessary veterinarian attention or improperly maintained according to the directions of this agreement.

The above guarantee is not transferable to a new owner, unless agreed to in writing by all parties, including the new owner, the original purchaser and the breeder.

The following terms shall apply to both the Discounted Price Plan and Guaranteed Price Plan:
** Any puppy that is returned to the breeder for any reason will be done so at the owner’s expense. **
There are no other guarantees or warranties implied or intended, unless otherwise agreed upon in writing by both seller and buyer.

You, being the buyer, fully agree that you will not hold Saylor American Bulldogs/Cotton Kennels owners, Louette Saylor and Tommy Stallings including but not limited to: their persons or family; their estate, assets, holdings, earnings or interests whether actual, future or projected, liable for any and/or all damages caused directly or in-directly by the American Bulldog covered under this "Puppy Purchase Agreement". Once this pup leaves our premises, you will then assume all responsibility for it, except for the stipulations agreed to in this document, according to the plan you chose.
